Article 3. The role of KYRO: an intermediary, not a provider of the Salon Service

(1) KYRO operates an online platform that connects Clients with beauty salons and barber shops.

(2) The Salon is the provider of the Salon Service and the professional with whom the Client concludes the contract for the Salon Service. When registering in Kyro Studio, each Salon declares that it acts as a professional (trader). The name and address of the Salon are displayed on its page in the Kyro App, and the Booking confirmation screen states that the Salon Service is provided by the Salon concerned and that KYRO acts as an intermediary for the Booking. The Client's rights as a consumer in respect of the Salon Service, including those concerning its quality, price and performance, are exercised against the Salon.

(3) The Intermediation Service consists of: displaying the Salon, its services, prices and available time slots, as communicated by the Salon; transmitting the Booking to the Salon; and sending the Client confirmations and reminders concerning the Booking.

(4) The Salon is responsible for the accuracy of the information it publishes on the Platform, including services, prices, duration, opening hours and photos. A User who finds incorrect or misleading information may report it in accordance with Article 11.

Article 4. The Account

(1) Making a Booking requires an Account. The Account is created on the basis of a name, an email address, a mobile telephone number and a password, and is confirmed by entering the code sent by email or SMS. The telephone number is requested so that the Salon can contact the Client about a change to a Booking and for the security of the Platform, in accordance with paragraph (5).

(2) The User must be at least 16 years old. The User confirms that this condition is met when creating the Account, in accordance with Article 2(2).

(3) The details provided when creating the Account must be true and must belong to the User. The Account is personal. The User may not transfer, lend or sell the Account.

(4) The User must keep the password and sign-in codes confidential. If the User suspects that a third party is using their Account, the User must change the password and inform KYRO.

(5) The telephone number is also used for the security of the Platform. In the event of serious misconduct, KYRO may block the telephone number associated with the Account so that it can no longer be used to create new Accounts.

Article 5. Bookings

(1) The Client chooses the Salon, the service, the Specialist (optional) and the time, no more than three weeks before the date of the Salon Service. Before the Booking is confirmed, the Kyro App displays the price and duration communicated by the Salon and the free cancellation deadline set by the Salon.

(2) A Booking is deemed confirmed when it is displayed in the "Programări" (Appointments) section of the Kyro App. The Salon receives the Booking at the same moment.

(3) Prices are set by the Salon. The final price may differ from the displayed price only if the Client and the Salon agree, at the Salon's premises, on the provision of a different or additional service.

(4) In justified situations, including illness or a day on which the Salon is closed, the Salon may cancel the Booking or propose to move it. The Client is informed through the Kyro App. KYRO is not liable for cancellations made by the Salon but, at the Client's request, assists the Client in finding an alternative.

Article 6. Cancellation and no-shows

(1) The Client may cancel a Booking directly in the Kyro App up to its start time.

(2) Each Salon sets its free cancellation deadline (for example, at least 24 hours before the time of the Booking). The deadline is displayed on the Salon's page, before the Booking is confirmed and on cancellation. A Client who cancels after this deadline has expired must inform the Salon as soon as possible.

(3) If the Client does not attend, the Salon may mark the visit as a no-show. A visit marked as a no-show has the following effects:

  • a) the session under a Subscription Plan is deemed used, in accordance with Article 8(2);
  • b) the Client does not receive a loyalty point for that visit, since it is not a Completed Visit;
  • c) the Salon may take the no-show into account when giving the Client Rating, in accordance with Article 9(4).

(4) KYRO does not withhold or collect any amount for cancellation or no-shows. If KYRO introduces deposits paid online, they will apply only after Clients have been informed in advance and after the Terms have been amended in accordance with Article 18.

Article 7. Payment

(1) The use of the Kyro App is free of charge for Clients.

(2) The Client pays for the Salon Service directly to the Salon, at its premises, using the payment methods accepted by the Salon. KYRO does not collect any amount from the Client, does not process card payments and does not store the Client's card details.

(3) The fiscal receipt or invoice for the Salon Service is issued by the Salon.

Article 8. Salons' Subscription Plans and Loyalty Programmes

(1) Subscription Plans are offered by Salons or by Specialists with the Salon's approval. The contract for the Subscription Plan is concluded between the Client and the Salon, and payment is made at the Salon. The Salon records the payment in Kyro Studio.

(2) A Subscription Plan covers one calendar month. Sessions not used in a month do not carry over to the following month, and a no-show uses up one session. The conditions of the Subscription Plan (the service, the number of sessions, the price and the Specialists) are displayed to the Client before the Client requests the Subscription Plan.

(3) The Client may cancel the Subscription Plan in the Kyro App. The month already paid for remains valid until its end. If the Salon changes the conditions of a Subscription Plan, the new conditions apply only from the next paid month.

(4) Refund requests and disagreements concerning a Subscription Plan are addressed to the Salon. At the Client's request, KYRO assists the Client in communicating with the Salon.

(5) Loyalty Programmes are run by each Salon or by a Specialist with the Salon's approval. The Client receives a member code in the Kyro App, which the Salon scans after a Completed Visit in order to award one point. Points are awarded only for visits and never for Reviews.

(6) Points are valid only at the Salon or with the Specialist that awarded them, cannot be transferred between Salons and have no cash value.

(7) A Client who has collected the number of points set by the Salon may book the service offered as a reward free of charge in the Kyro App. If the reward Booking is cancelled, the points are returned to the Client.

(8) The Salon may end the Loyalty Programme. Rewards for which the Client has collected, by the date on which the programme ends, the number of points set by the Salon remain valid and are honoured by the Salon.

Article 9. Reviews and Client Ratings

(1) After a Completed Visit made through the Platform, the Client may publish a Review of the Salon and, optionally, of the Specialist. The full rules, including how the average rating is calculated, are set out in Rules on reviews.

(2) A Review must describe the Client's real experience of the visit concerned and comply with the rules in Article 10. A Review may not be paid for, bought or given in exchange for a benefit, and may not be written on behalf of another person.

(3) By publishing a Review, the Client grants KYRO a free, non-exclusive licence to display the Review in the applications of the Platform, in the KYRO web app and on the Salon's page for as long as it is published. The Client retains the rights in the Review, may edit it at any time, and the Review is deleted when the Account is deleted.

(4) After the date of a Booking, including one marked as a no-show, the Salon may give the Client a Client Rating. A Client Rating is visible only to the Salon that gave it and to the Client concerned; it is not visible to other Salons. The Client may view the Client Rating in the Kyro App, in the "Cum te văd saloanele" (How salons see you) section, and may report it from there. Client Ratings are deleted automatically 2 years after they are given.

  • f) advertising, spam or links, as well as, in Reviews and replies, Content unrelated to the visit;
  • g) photos or texts for which the person publishing them does not hold the necessary rights.

(2) It is prohibited to use the Platform for:

  • a) false Bookings or Bookings made in order to block time slots;
  • b) harassing Salons, Team Members or other Users;
  • c) attempts to circumvent the security measures or filters of the Platform;
  • d) automated data collection;
  • e) creating multiple Accounts in order to evade a block;
  • f) any illegal activity.

Article 11. Reporting, blocking and moderation

(1) A User may report any Review, Salon reply, photo, Salon page or Client Rating received from a Salon, using the "Raportează" (Report) button displayed next to the Content concerned or by writing to [email protected]. Salons may report the Reviews they receive.

(2) A Client may block a Salon or the author of a Review. After blocking, their Content is no longer displayed to the Client in the Kyro App. The Client may remove the block in the Kyro App or by writing to KYRO.

(3) Before publication, Reviews, Salon replies and the comments in Client Ratings are checked by an automatic filter that rejects profanity and insults. A User whose text is rejected may rephrase it.

(4) Each report is transmitted to the KYRO team when it is submitted. KYRO examines the report diligently and objectively and takes a decision within no more than 24 hours of receiving it. Decisions are taken by people in the KYRO team, not by an automated system. The removal of Content published by another User falls within the exclusive competence of KYRO. Salons cannot delete, hide or modify Reviews.

(5) Where KYRO removes or restricts a User's Content or Account, KYRO sends the User a statement of reasons setting out the decision taken, the facts and circumstances on which it is based, the rule breached and the means of redress.

(6) The full procedure, including the points of contact required by Regulation (EU) 2022/2065 on digital services (the "DSA"), is described in Points of contact and reporting of content (DSA).

Article 12. Restriction, suspension and closure of the Account by KYRO

(1) KYRO may remove Content and may restrict, suspend or close an Account in any of the following situations:

  • a) the User seriously or repeatedly breaches the Terms, including by false Reviews, harassment, objectionable Content or repeated false Bookings;
  • b) the User publishes illegal Content;
  • c) the measure is necessary for the security of the Platform or of other Users;
  • d) the measure is required by law or by an authority.

(2) The measure is proportionate to the seriousness of the conduct and may consist, in order of seriousness, of the removal of Content together with a warning, the temporary suspension of the Account and, for serious or repeated breaches, the closure of the Account.

(3) KYRO sends the User the statement of reasons before the measure is applied or, at the latest, on the date it is applied, unless such communication is prohibited by law.

(4) The User may challenge the decision by replying to KYRO's message or by writing to [email protected]. KYRO is required to review the challenged decision.

(5) In the event of serious misconduct, KYRO may also block the telephone number associated with the Account, in accordance with Article 4(5).

Article 13. Deletion of the Account

(1) The User may delete their Account at any time in the Kyro App, in the "Cont" (Account) section.

(2) Deletion of the Account is permanent and results in the deletion of the Account, the profile, the profile photo, the Client's Reviews and the allergy notes associated with the Account, at all Salons.

(3) Each Salon retains, as a separate controller, the record of the visits made to it, without that record remaining associated with the Account.

(4) On deletion of the Account, the Client loses the points collected in Loyalty Programmes, and the Subscription Plans end and are deleted, including the record of payments noted by the Salon. Article 15. Liability

(1) KYRO is liable for the Intermediation Service in accordance with the law, including for damage caused intentionally or through gross negligence and for damage to life, physical integrity or health. No provision of the Terms limits the rights conferred by law on the User as a consumer, including those under Law no. 193/2000 on unfair terms in contracts concluded between professionals and consumers and Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals.

(2) The Salon is liable for the Salon Service, including its quality, safety, price and hygiene and compliance with the Booking, as well as for the information it publishes about it.
